In such cases, appropriate information will be provided to the user, and where necessary, the user will be invited to give their consent. The processing of the data provided by the user will comply with the purposes and methods indicated in this information notice and the specific information notices provided from time to time.

Data provided directly by the data subject by sending communications using the contacts on the site.
Explicit and voluntary sending of messages to the contact addresses in the dedicated section involves acquiring the sender’s contact data and all personal data included in the communications. These data are processed for the following purposes and in compliance with the relevant legal bases for processing, for a retention period not exceeding that necessary for the purposes for which they were collected and processed.

  • Type of data processed: name and surname, email, subject, and message.
  • Purpose of processing:
  • Managing the request sent by the user;
  • Providing the requested service (e.g., quotes, information requests, etc.);
  • Legal Basis:
  • The processing is necessary to respond to requests; for the execution of pre-contractual and contractual measures adopted at the request of the data subject.

  • Contractual purposes related and instrumental to establishing and managing relationships with customers and/or suppliers, such as acquiring preliminary information for the possible conclusion of a contract;
  • Fulfilling obligations provided by state laws, regulations, and community norms, or instructions given by authorities empowered by law and control or supervisory bodies (e.g., tax, accounting, administrative, etc.);
  • Exercising the rights of the Controller in court and managing any disputes.

Collecting data and information in an exclusively aggregated and anonymous form to verify the site’s correct functioning, aiming for continuous improvement. None of this information is related to the physical person-user of the site and does not allow their identification in any way.

Collecting data and information to protect the site’s security and users (spam filters, firewalls, virus detection) and to prevent or unmask fraud or abuse against the website. The data, including domain names of computers used by users who connect to the site, addresses in URI (Uniform Resource Identifier) notation of the requested resources, request time, the method used to submit the request to the server, the file size obtained in response, the numeric code indicating the server response status (successful, error, etc.), and other parameters related to the user’s operating system and IT environment, are automatically recorded and may also include personal data (IP address) that could be used, in compliance with current laws, to block attempts to damage the site or harm other users, or otherwise harmful or criminal activities. Such data is never used for user identification or profiling and is periodically deleted.

Cookies are small text strings that sites visited by the user send to their terminal (usually the browser), where they are stored to be retransmitted to the same sites on the next visit by the same user. During site navigation, the user may also receive cookies sent by different sites or web servers (so-called “third parties”), on which some elements present on the site they are visiting may reside (such as images, maps, sounds, specific links to pages of other domains). Cookies, usually present in users’ browsers in a high number and sometimes with wide temporal persistence characteristics, are used for different purposes: performing computer authentication, monitoring sessions, storing information on specific configurations regarding users accessing the server, etc. For further details, refer to the site’s Cookie policy.

The user is free to decide whether or not to provide their personal data through this website and/or its connected services. Failure to provide the data, as indicated on a case-by-case basis in the information provided to the user, may result in the inability to provide the requested service. The mandatory nature of the requested information is marked with an asterisk (*).
Refusal to provide certain data marked as mandatory makes it impossible to pursue the primary purpose of the specific collection: such refusal could, for example, make it impossible to provide responses to the user or other services potentially available on this website.
The provision of additional data to Instead of Mlk, other than those marked as essential, is optional and does not affect the pursuit of the primary purpose of the collection.

Through the Instead of Mlk website, you can share content via social networks. The user is free to decide whether and which content to share on one or more social networks (Facebook, Instagram, etc.). In such cases, we inform you that no personal data of the user is acquired by Instead of Mlk and the user is invited to verify their account settings on the social network to identify any data acquired by external platforms. For more information, you can consult the website of the social network(s) to which the user is registered (www.facebook.com, www.instagram.com, www.pinterest.com, etc.).

Personal data will be processed by personnel in charge of developing and managing the website who are authorized to process them to achieve the previously indicated purposes and who have committed to confidentiality or received an appropriate legal obligation of confidentiality.
Personal data will be processed by entities appointed as data processors as they process data on behalf of the Controller (e.g., entities necessary to interact for service provision such as hosting providers, email platform providers, or entities delegated to perform technical maintenance activities, including network and electronic communication network maintenance).
Personal data may be shared with third parties with whom the Controller has ongoing contractual relationships for services functional to the activity (e.g., companies managing and fulfilling sales orders, carriers for product delivery, individuals, companies, or professional firms providing assistance and consultancy in accounting, administrative, legal, tax, financial, and credit recovery matters related to service provision, etc.).
Data may be communicated, even without consent, to all inspection bodies authorized to perform checks, such as the Revenue Agency, ministerial entities and competent authorities, local entities, tax commissions of all levels, upon their express request, which will process them as independent data controllers for institutional purposes and/or by law during inspections and controls.
Personal data is not intended for publication or dissemination.
The complete list of appointed processors is available from the Controller.
Data will be processed by the Controller in Italy and within the European Union and the European Economic Area. If for technical, organizational, and/or operational reasons it becomes necessary to use entities (among those listed above) located outside the European Union or the European Economic Area, Instead of Mlk ensures that data processing by these entities will comply with applicable law. Transfers will be made using appropriate safeguards, such as adequacy decisions, standard contractual clauses approved by the European Commission, or other safeguards deemed adequate. The data subject can request more information by writing to the email address at the beginning of this information notice.

Personal data processing will always be based on principles of fairness, lawfulness, transparency, and data protection through technical and organizational security measures to ensure an adequate level of protection.

Personal data processed for the purpose of Service/Product Provision and Contractual Obligations will be retained by the Controller for the time strictly necessary to perform the requested service and correctly execute the contractual relationship with the user. Since such personal data are processed to provide services and enable the execution of the contractual relationship, the Controller may retain them for a longer period, particularly as necessary to protect the Controller’s interests from potential liabilities related to the products. At the end of this period, the data will be deleted.

User requests and the data contained therein will be kept for the time necessary to allow the Controller to identify the correct closure of the request and in any case, as necessary to protect the Controller’s interests from potential liabilities. At the end of this period, data that allows identification, even indirectly, of a natural person (such as name, email) will be anonymized and kept in aggregated form for statistical purposes.

Personal data processed for the purpose of Legal Obligations will be retained by the Controller for the period provided by specific legal.

Unless otherwise specified, the processing of personal data will take place for the entire period during which the user utilizes this website and the services provided through it. In the event of withdrawal of consent, the personal data will be retained by the Data Controller to demonstrate compliance with their obligations until the applicable statute of limitations has expired.

Articles 15 and following of the GDPR EU 2016/679 grant specific rights to data subjects. In particular, they have the right to obtain confirmation of the existence or non-existence of personal data, access to personal data, and the rectification or erasure of such data or the restriction of processing that concerns them, or to object to their processing, in addition to the right to data portability, the communication of such data, and the purposes on which the processing is based. Furthermore, data subjects have the right to withdraw consent at any time without affecting the lawfulness of the processing based on consent before its withdrawal, to transform data into anonymous form or block data processed in violation of the law, as well as to update or, if there is an interest, to integrate data. Data subjects have the right to object, for legitimate reasons, to the processing itself.

The exercise of these rights is not subject to any temporal constraint and can be carried out free of charge by contacting the Data Controller at the references provided at the beginning of this policy via regular mail and/or email.

Data subjects who believe that the processing of personal data concerning them carried out through this site is in violation of the provisions of the Regulation have the right to lodge a complaint with a supervisory authority (for Italy: the Italian Data Protection Authority www.garanteprivacy.it), as provided for by Article 77 of the Regulation, or to take appropriate legal action (Article 79 of the Regulation).

COOKIE POLICY – Extended Information

This policy, together with the Privacy Policy, outlines certain management rules on the insteadofmlk website, particularly concerning the use of user information. This section specifically provides information regarding the cookies active on the site and how they are used. The following Cookie Policy (or “Extended Information on Cookie Use”), related to the use of cookies on the website, is provided to the user in implementation of the Italian Data Protection Authority’s provision “Identification of simplified procedures for information and the acquisition of consent for the use of cookies,” in compliance with the additional clarifications and guidelines issued by the same Authority, national regulations, and competent European Authorities (see “Guidelines on cookies and other tracking tools – June 10, 2021”).

A “cookie” is a small text file installed by certain websites on the user’s computer when they access a specific site or use certain services offered by that site. The purpose is to store and transport information. Cookies are sent from a web server (which is the computer running the visited site) to the user’s browser (Mozilla Firefox, Google Chrome, Edge, etc.) and stored on their device. For more information and to learn more about cookies in general, you can visit www.allaboutcookies.org.

In general, cookies can be used for various reasons, such as monitoring the use of the site by visitors, improving the navigation of pages, allowing users to set personal preferences on the sites they visit, protecting user security, and presenting advertisements based on visitors’ interests.

Cookies can generally be categorized based on:

  • Duration of storage on the user’s device: This includes session/temporary cookies or persistent cookies.
  • Origin: This includes first-party cookies (sent directly from the site being visited) or third-party cookies (sent from other sites).
  • Purpose: In line with the guidelines from the Data Protection Authority, this includes technical cookies or analytical and profiling cookies.

A single cookie can have multiple characteristics, such as being a persistent third-party cookie with a profiling purpose.

  • Session/temporary cookies: Not stored persistently but only for the duration of the browsing session. They are automatically deleted from the user’s device once they exit the website and close the browser.
  • Persistent cookies: Stored on the user’s device until they are deleted by the user or until they reach their pre-set expiration date. They are not automatically deleted when the user exits the website.

  • First-party cookies: Released by the website visited at that moment.
  • Third-party cookies: Released by a different website than the one the user is visiting.

  • Technical cookies: Essential for navigating the site and using specific features. They can be divided into:
    • Navigation/communication/performance cookies: Ensure normal navigation and use of the website (e.g., enabling purchases or authentication for accessing restricted areas). Blocking these cookies may cause the site to malfunction.
    • “Strictly necessary” cookies (functionality/preferences/location/session status): Allow storing information that changes the behavior or appearance of the site (preferred language, text size, geographic area). Blocking these cookies will make navigation less functional but not compromised. These cookies allow the site to remember user choices (e.g., language preference) and provide personalized functionalities, improving the navigation experience. In some cases, these cookies can also offer online services (e.g., live chat) or avoid offering services previously declined by the user.
  • Analytical cookies: Used to gather information on user access, such as the number of visitors, the duration of visits, and visited parts of the site. These cookies can be first or third-party.
    • Third-party statistical/analytical cookies without identification power (with IP masking and no cross-referencing with other data): These cookies can be assimilated to technical cookies if they meet the following conditions: reducing the identification power of the cookies through IP masking, third-party commitment to use these cookies exclusively for service provision, storing them separately, and not “enriching” or “cross-referencing” them with other data.
    • Third-party statistical/analytical cookies with identification power: Used to collect information and generate website usage statistics to understand visitor interactions. These cookies are highly identifiable if the following conditions are not met: no measures to reduce identification power (e.g., IP masking), and the third party cross-references cookie information with other data.

This site uses various types of cookies and related technologies, each with a specific function. The site can be navigated without cookies, but the experience may not be optimal. The site uses the Cookie Solution system (or CMP – Cookie Management Platform) provided by CookieYes – policy CS – allowing users to detect and save their preferences regarding the collection, use, and processing of their personal information, as required by applicable legislation. For details on the cookies used, refer to the banner displayed upon opening the site, which provides granular information. Users can review the status of previously given consents by clicking the graphic symbol at the bottom of each web page.

  • Navigation and session cookies: Ensure normal website navigation and usage (e.g., identifying bots and protecting the site from malicious spam attacks). These are technical cookies necessary for the site’s functionality, enhancing quality and navigation experience. They do not store personal identification data. The website cannot function correctly without these cookies.
  • Analytical and statistical cookies: Used to collect and process statistical analyses on user navigation methods, number of visits, pages visited, or clicks made during website navigation. The information generated about our website is used to create reports on site usage to improve usability, functionality, interface, and communication. The results of these analyses are treated anonymously and exclusively for statistical purposes. Among the identified service providers is Google (third party), so the data collected may be subject to extra-EU transfer. For Google’s cookie policy, Analytics services, and cookies policy refer to their provided links.

Third-party requests refer to those a site makes to load content from third-party domains. These connections can be subdomains of the site’s domain or unrelated domain names. While some third-party requests are necessary for site functionality (e.g., content from a content distribution network), others are used for advertising, social media buttons, tracking scripts, or other content. This site uses content services provided by Google (fonts.googleapis.com, fonts.gstatic.com, etc.). For more information, refer to the provider’s policy – Google Privacy Policy.
